Privacy Policy

Mesmer LLC ("Company," "We," "Us," or "Our"), doing business as SimClient AI ("DBA SimClient AI"), respects your privacy and is committed to protecting it through this Privacy Policy.

This Privacy Policy governs access to and use of our websites and mobile applications, including Mesmer: AI Hypnosis & Sleep and SimClientAI (collectively, the "Services" or "Apps"), as well as any content, functionality, and services offered, whether as a guest or registered user. The policy applies to information collected on the Services, and through email, text, or other electronic messages between you and Mesmer LLC.

Age Restrictions

The Services are not intended for persons under 18 years of age. The Company does not knowingly collect personal information from minors and will delete such information if discovered. Users under 18 should not provide information, register, or access the Services.

Information We Collect Through Our Mobile Apps

When you use our mobile Apps, we and our third-party service providers collect the following data to operate the Apps, manage your account, process subscriptions, and understand how the Apps are used:

  • Account information. If you create an account or sign in using email and password, Google Sign-In, or Sign in with Apple, we collect your email address, display name, and profile photo (where provided by you or the sign-in provider), and a unique user identifier. You may also use the Apps anonymously with a temporary account identifier.
  • Content you provide. We collect information you enter into the Apps, such as the goals, feelings, or topics you provide to generate a personalized session. This content is stored to deliver and improve your sessions.
  • Device and advertising identifiers. We collect device identifiers used to associate app usage with your account for analytics. With your permission, we also collect a device advertising identifier (the IDFA on iOS or the Advertising ID on Android), which is shared with Meta so we can measure the effectiveness of our advertising.
  • App activity. We collect information about how you interact with the Apps, such as sessions started and completed, features used, and content accessed, for analytics purposes.
  • Purchase history. When you subscribe or make a purchase, we collect records of your transactions and subscription status to deliver and manage your subscription.
  • Push notification tokens. If you enable notifications, we collect a device push token so we can notify you (for example, when a custom session is ready).
  • Apple Health (optional, iOS only). If you enable the Apple Health integration, the Apps write your completed mindfulness minutes to Apple Health on your device. We do not read data from Apple Health, and this information is stored on your device by Apple, not transmitted to us.

This data is transmitted off your device to us and to the third-party service providers described below, except where noted (such as Apple Health data, which remains on your device).

Third-Party Service Providers in Our Apps

We use the following third-party services to operate our Apps. These providers process certain data on our behalf and in accordance with their own privacy practices:

  • Google Firebase — provides authentication, database, storage, and backend functions. Firebase processes account information, user identifiers, and content you provide.
  • RevenueCat — processes subscription and purchase history data to manage in-app subscriptions.
  • Mixpanel — processes device identifiers and app activity data to provide usage analytics.
  • Meta (Facebook) — we use the Meta SDK to measure the performance of our advertising. When you install the App after seeing one of our ads, or make a purchase, we share an advertising identifier and event data (app installs, app opens, and purchase amount and currency) with Meta. We do not share the content of your sessions, the goals or feelings you write, or any other information you enter into the App. On iOS, we request your permission before using the advertising identifier; if you decline, we do not use it. You can change this at any time in Settings → Privacy & Security → Tracking. Meta's use of this data is governed by their privacy policy at https://www.facebook.com/about/privacy.
  • Google Sign-In and Sign in with Apple — used to authenticate you if you choose those sign-in methods; they provide us your email, name, and profile photo as permitted by you.

Payments for subscriptions are processed by the applicable app store (Apple App Store or Google Play), subject to their respective privacy policies.

Information Collection (Website)

The Company collects information both voluntarily provided and automatically gathered on our Website.

Voluntarily Provided Information. Users provide information through forms, contact submissions, surveys, search queries, comments, feedback, or product/service orders. This information supports delivery of requested services, performance improvement, and promotional communications.

Automatic Data Collection (Website). The Website employs automatic data collection technologies, such as Google Analytics, to collect information about your equipment, browsing actions, and patterns. This includes location data, traffic patterns, communications data, computer type, internet connection, IP address, operating system, and browser type.

Cookies and Tracking Technologies

Our Website uses standard technologies called "cookies" and server logs to collect information about site usage. A cookie is a small text file, often containing an anonymous unique identifier, stored on your device.

The Company reserves the right to use technological equivalents of cookies, including social media pixels, to tailor advertising messages on social media platforms.

Third-Party Tracking: Third-party providers may use cookies, web beacons, or tracking technologies to collect information about online activities for interest-based advertising, which the Company does not control.

Email Communications

The Company retains email content, addresses, and responses with the same security protections as other communications. The Company commits to keeping email addresses confidential and will not disclose them except as outlined in the disclosure section.

The Company maintains compliance with the CAN-SPAM Act. All emails include sender identification, contact information, and unsubscribe instructions. Users may opt out by clicking unsubscribe links or contacting info@mesmer.life.

How We Use Information

Information is used to provide and operate the Services, authenticate users and manage accounts, generate and deliver personalized sessions, process and manage subscriptions, send notifications you have enabled, measure and improve performance through analytics, provide offers, fulfill contracts, administer customer service, and display tailored advertisements based on user characteristics and interests.

The Company may share information with third parties for commission-based product/service offerings if users opt in.

How We Share Information

The Company does not sell or rent your personal information. We share information as follows:

  • With third-party service providers that process data on our behalf to operate the Apps and Services, including Google Firebase (authentication, database, backend), RevenueCat (subscription management), Mixpanel (analytics), and Meta (advertising measurement), and website analytics providers.
  • With subsidiaries, affiliates, or service providers.
  • With third parties enforcing our Terms of Use or agreements.
  • With successors during business transitions.
  • With entities legally compelled by law or government, or when the Company believes in good faith that disclosure is necessary to protect legal rights.

Data Retention and Deletion

We retain your data for as long as necessary to provide the Services and as required for legal, tax, accounting, or fraud-prevention purposes. You may delete your account and associated data at any time directly within the App's Profile menu, which removes your account information, saved content, generated sessions, and activity. Instructions are also available at https://mesmer.life/delete-account.

Security Measures

The Company uses commercially reasonable methods to secure information you provide and data we collect automatically, including standard security protocols and reputable third-party vendors. Data transmitted between our Apps and our service providers is encrypted in transit using industry-standard protocols.

Email is noted as insecure; sensitive information like credit card details is transmitted via Secure Sockets Layer (SSL) and never via email.

Policy Updates

Changes are posted on the policy page. Material changes are communicated via email and website notices. Users are responsible for maintaining current contact information and reviewing updates.

GDPR Rights (European Union Users)

EU residents have rights including: access, rectification, or erasure of their data; restriction of or objection to processing; data portability; withdrawal of consent without affecting prior lawful processing; and the right to file a complaint with a supervisory authority. The Company collects only necessary information for contracts and does not mandate consent for unnecessary processing.
